{"id":343,"date":"2023-06-28T14:10:42","date_gmt":"2023-06-28T11:10:42","guid":{"rendered":"https:\/\/pmioveni.ro\/?p=343"},"modified":"2023-06-28T14:20:45","modified_gmt":"2023-06-28T11:20:45","slug":"decontarea-ratelor-anterior-legii-knockout","status":"publish","type":"post","link":"https:\/\/pmioveni.ro\/index.php\/2023\/06\/28\/decontarea-ratelor-anterior-legii-knockout\/","title":{"rendered":"Decontarea ratelor anterior legii &#8211; KNOCKOUT"},"content":{"rendered":"\n<p class=\"has-black-color has-text-color\">RIL: ICCJ a stabilit c\u0103 decontarea ratelor poli\u021bi\u0219tilor nu se va mai face anterior legii de aplicare.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">\u00cenalta Curte de Casa\u021bie \u0219i Justi\u021bie (ICCJ) a stabilit c\u0103 poli\u021bi\u0219tii care au \u00eencheiat contracte de credit ipotecar sau imobiliar \u00eenainte de apari\u021bia legisla\u021biei <em>NU au dreptul la compensa\u021bie lunar\u0103.<\/em><\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Decizia ICCJ va deveni obligatorie dup\u0103 publicarea \u00een Monitorul Oficial.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Probabil va fi motivat\u0103 pe baza principiului neretroactivit\u0103\u021bii legii civile \u0219i vor fi luate \u00een considerare aspecte specifice privind stabilirea calit\u0103\u021bii de beneficiar al compensa\u021biei lunare.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">M\u0103surile de decontare introduse prin Legea nr. 288\/2018 se aplic\u0103 \u0219i \u00een ceea ce prive\u0219te decontarea ratelor \u00een r\u00e2ndul cadrelor militare, dar RIL-ul <em><u>se refer\u0103 exclusiv la decontarea ratelor poli\u021bi\u0219tilor.<\/u><\/em><\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Decizia ICCJ va deveni obligatorie pentru toate instan\u021bele de judecat\u0103 atunci c\u00e2nd se vor pronun\u021ba asupra unor chestiuni similare \u0219i nu va mai permite interpret\u0103ri cu privire la aceast\u0103 problem\u0103.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Av\u00e2nd \u00een vedere solu\u021biile deja definitive, vom fi nevoi\u021bi s\u0103 pl\u0103tim deconturi de chirie anterioare legii, \u00een timp ce, pentru viitor, consider\u0103m c\u0103 situa\u021bia este deja rezolvat\u0103 \u0219i \u00een cazul nostru.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Ar fi fost prea frumos ca povestea s\u0103 se \u00eencheie cu un final fericit.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">\u00cen plus, \u00een ceea ce prive\u0219te posibile practici neunitare \u00een interpretarea efectelor decontului \u00een sistemul penitenciar (ceea ce ne e greu s\u0103 credem c\u0103 o s\u0103 mai existe), este doar o chestiune de timp p\u00e2n\u0103 c\u00e2nd va fi emis un RIL referitor la articolul din statutul poli\u021bistului de penitenciare.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Dar, cu toate acestea, suntem convin\u0219i c\u0103 motivarea va con\u021bine suficiente considerente pentru a stabili un punct de referin\u021b\u0103 pentru noi \u0219i pentru a evita pierderile de timp \u0219i speran\u021bele de\u0219arte.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><em>Concluzie:<\/em><strong> &#8211; <u>KNOCKOUT<\/u> &#8211;<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><em>Mai jos, solu\u021bia: Decizia nr.12 din 19.06.2023: Admite recursul \u00een interesul legii declarat de Colegiul de conducere al Cur\u0163ii de Apel Suceava \u015fi, \u00een consecin\u0163\u0103, stabile\u015fte c\u0103: \u00cen interpretarea \u015fi aplicarea unitar\u0103 a dispozi\u0163iilor art. 31 alin. I din Legea nr. 288\/2018 pentru modificarea \u015fi completarea unor acte normative, dreptul la compensa\u0163ia lunar\u0103 pentru chirie, pentru plata ratelor de credit, nu poate fi recunoscut poli\u0163i\u015ftilor care au \u00eencheiat contracte de credit ipotecar\/ imobiliar anterior intr\u0103rii \u00een vigoare a Legii nr. 288\/2018. Obligatorie, potrivit dispozi\u0163iilor art. 517 alin. (4) din Codul de procedur\u0103 civil\u0103.
